Can't seem to find enough content about the Merkey Lawsuit.

Anybody hosting a website a la GL on the topic - filings, commentary, etc?

This document (UNSERVED DEFENDANT ALAN P. PETROFSKY'S MEMORANDUM IN OPPOSITION TO PLAINTIFF JEFFREY VERNON MERKEY'S EX-PARTE MOTION TO CONDUCT EXPEDITED DISCOVERY) is a fun read.  Apparently Al has not recieved ANY documents relating to the case (complaint, summons, motions or memorandum) but decided to file anyway - and manages to call Merkey a "raving lunatic" in ¶2 and then brings quotes from a prior Novell case (Novell v. Timpanogas Research Group) wherein Merkey apparently "not only exaggerat[es] but is and can be deceptive" (ref'd ¶124).

Good read, seems Al is (at this time) representing himself.   This is the first non-Merkey & non-Court filing listed in Pacer.  I hope to have HTML/TXT up tomorrow.

Anyone know the rules of what happens if no one recieves the complaint?  Does Merkey destroy his own case?

At this point, most of the information concerning Mr. Merkey and his lawsuit is scattered about the 'net.  Not sure it would ever warrant a whole site devoted to it.

I am working on a page to post here at this site concerning the suit, but I'm waiting on some replies from others concerning legal strategies before I make it available.  In the meantime, there are several articles and diaries here touching on different aspects.  And users are welcome to do more if they are so inclined.

As for legal documents, they are available at tuxrocks.com if you know where to look (they are currently hidden, but I don't know if it is on purpose or not - part of my reason for assembling a little easier to access page).

There is a user over at the Y! SCOX board, simon_g_best, who I think is working on a site regarding the Merkey lawsuit, but I think he is specifically looking for something outside the U.S. so Merkey is really stuck if he tries to do anything about it (that is jmo).

Haven't digested it all, but the idea of the "chilling effect on free speech" of aggressive and and unwarrented discovery of annonymous postings certainly resonates with me.

See this Y!SCOX post from a couple of weeks ago. It references links here and here.

Basically he got owned. NANAS shows about 70 other  related phishing attempts pointing to various compromised boxes worldwide.

Summons have been issued by the Court in matter 2:05-cv-521 DAK-SA for Al Petroksky and Jeff Causey. These summons have been sent to the parties at their known and verified addresses of service certified US Mail.

Apparently, the fact tha EFF/ACLU filed an amicus brief is now "chilling" free speech on SCOX....

also, related somehow:  
someone has "..used Merkeylaw as a phishing server to break into the Federal Credit Union...".

Anyone have any idea what this guy is talking about?

Mr. Merkey is interacting with the Yahoo! SCOX board today. Over 30 posts so far. Some of the posts, if true, may provide unique insight on issues regarding Yarro, Canopy, SCOG, etc.
