SS IPW Takes A Hit

As regular visitors to the site are aware, IPW has been down for about 24 hours or so. This is related to the lawsuit filed against me and this site by Jeff Merkey. As most folks also know by now, a settlement has been reached in that lawsuit. Yes, it sucks! That is part of the reason why I took the site down as I struggled to make that happen.

"Why?" I'm sure you are asking. It had nothing to do with the merits of Merkey's case or a lack of willingness on my part. At this time, me and my family are under a lot of stress completely unrelated to this site. Once the papers were actually served on me, that added to it, especially for my wife. And although she fully understands Merkey's suit and claims are bogus, she did not feel she was up to the added trouble and stress of a lawsuit (despite my confidence in a quick and easy victory). After much debate and discussion between us, she finally asked me to do whatever I could to get the suit dismissed just because she was asking me as my wife. She has never failed to support me throughout our years of marriage and the ups and downs, so throwing my support behind her was not a difficult decision to make.

Although the decision was easy to make, going through with it was extremely difficult. There have been few times in my life when I have felt as sick about what I was doing as I did in this case. It goes against some very deeply held beliefs of mine. Nevertheless, doing what I could to protect my wife is more important to me than the opportunity to prove I'm right and Merkey is not.

But there is good news - I just saved a bunch of money on my car insurance by switching to GEICO! Ha ha! Although I (and by extension this site and everyone that has contributed to it) have taken a hit, there will be another day. Hopefully, the open nature of this site means there may be some mirrors that have captured the content. So although this "node" may have been nicked, the truth will continue to float out there. For the record, the following articles have been supressed(at least on this site):

Well, first of all, thanks to everyone who has been posting in this thread.  I've been so despondant over all this, I have not even wanted to get on the 'net over the weekend.  Reading what I have read here has changed that.

And my thanks goes not only to those who have supported my decision, but those who have been critical as well.  I do have to say that the criticisms strike home with me as I think they are the type of issues that made me so sick at what I did.  The threat (nee elimination?) to the possibility of free speech on this site.  The integrity of the site.  The breach it has created for future actions against the site.  And I very much considered taking the site down completely.

That said, having read some of the comments here has helped me to clear my head a bit and start the natural analysis that I tend to do (and once again demonstrates the "many eyeballs" strength of the open source method as many here have identified issues I never would have seen on my own).  First, I look back at the history of the site a bit.  As some have commented, the specific effort to CCL everything here is unusual (not sure we are the first or only doing it, but I have to guess we are out in front with it).  That was a conscious decision to help protect against this site going down.  It was also a result of everyone here debating the issues and providing their input.

We have also had extensive discussion here about policies to help protect against other potential threats.  The site has a history of debate about what measures need to be put in place to help protect it.  We now have this unfortunate incident where we did not anticipate this particular type of attack and had no plan of action.  But that does not mean we can't make the necessary changes needed to withstand the next attack.  In fact, I'm heartened to see many of the contributors here already starting on that.

To go back to the "war" metaphors, when you are on the front lines, you have to expect to take some casualties.  When that happens, you can't turn tail and run.  Instead, you figure out how to continue the fight in spite of the casualties you've suffered.  Certainly, some may think what has happened is a fatal blow.  imo, while a nasty hit, it does not have to be fatal.

Or, to turn to a sports metaphor, you can't expect to shut out the other side every game, sometimes you'll even find yourself down, but as long as there is time on the clock, you keep playing in an effort to come back.

So yes, I have been knocked down and bloodied (and everyone who has contributed to the site as well).  But now I'm standing up, spitting the blood out of my mouth, knocking some dust off, and getting myself braced for the next round.  Hopefully, everyone here will do the same.

With all that said, I would like to add some input to help with this process of fortifying our position.  The first thing that I have realized is the EFF and some of the other folks I contacted are severely limited in what they can do.  In fact, I'd say they are really only able to handle potential "precedent" setting cases.  This means the average blogger or forum owner who gets hit with a nuisance suit is on their own.  I'm not sure what the solution is - a legal fund established ahead of time?  hope someone creates a product that individuals could afford to help protect themselves?  setup some kind of cooperative or association to spread costs?  Whatever the solution, something needs to be done to ensure that not only the wealthy are able to avail themselves of the power of free speech and the Internet (alas, this disparity between rich and poor exists in meatspace as well).

In this situation, a human element was introduced that affected the outcome as well.  We never know when someone who is willing to fight may get hit with other stuff at the same time that negates that willingness or ability to fight.  And the threats are not only legal in nature.  Quite frankly, I could drop dead tomorrow and the site would probably go down.  This all leads me to the model of the Internet where it was designed to withstand weaknesses or breaks and can basically, route itself around problems.  Perhaps more needs to be done to ensure that the flow of information on sites like this can continue even when a site goes down.  More mirrors needed?  More aggressive recruitment of mirrors?  Some type of multiple ownership to help harden each site?

And at this site, we now see some specific issues for me to address.  Does the site need to be transferred to someone else?  A corporation setup to own the site?

As you can see, there are multiple levels that need to be addressed and there will be interaction between them.  I would suggest one goal would be to design some solutions that provide a disincentive to people who want to shut down sites via the court system.  I'm sure other goals need to be set as well.

Already, there are members of this site who have started work on these issues and I'm thankful for that as their knowledge and input has proven invaluable in the past.  I invite everyone to join in that effort.

I also wanted to express my praise and support for the way you handled this.

You have been very open about Jeff's initial contact.  When you finally came to the conclusion that the best thing at this time was to make some changes, you were completely open about how you came to that decision and about exactly what had changed.

That is much more than we can expect.

Jeff,

I'm not going to second guess or criticize your decision. I understand what it's like to be faced with no good choices. And I certainly believe that fighting a lawsuit is a life-wrenching experience for any person—and extremely stressful for your family and friends. A lawsuit is not a joke.

Beyond that, I'm kind of at a loss for words. I just hope, despite how sick you felt carrying out your decision, that in time you reach some kind of peace within yourself about it. It's just not possible to fight and win every battle, so you have to gauge your resources against the wars you can't afford to lose.

i tried writing last nite and it sounded so sarcastic that i couldnt post it and i dont even think i feel sarcastic about your decision.
i have had a long year and stress has been extremely riough so i understand what your wife is feeling.
you owe her before you owe anything to us.
i appreciate your honesty.
some say we came here because of censorship but i feel it was more than that.
we wanted basic honesty and respect for each individual.
i feel disappointment right now but i do understand.we sacrifice much in life for our families.

I think in all the work that was done on creating IP-W we overlooked one thing.  While the creation and contribution to the site has always been a shared effort, the risk and responsibility for what is published has always rested on Jeff Causey and his hosting company.

Jeff has given his time and efforts selflessly to this site and in my mind has been a very adept and  benovolent ruler.  A well deserved thanks to you Jeff.

I think however that we made the same mistake as the original Napster, we set ourselves up with a single vulnerable point.  While I and others would have been able to offer some financial help to Jeff, we had no way of sharing the distress this was causing and would have caused his family.

I think the challenge now might be to move IP-W to a more distributed model where one single person is not bearing all the risk.

We have some good minds here I am sure that we can find a way to make IP-W more resistant to the sort of attack JVM put forth.

I agree you had every right to handle this as you see fit.  I hope this is the end of the Merkey problem; I am not sanguine.

I must admit to being disappointed, but having come incredibly close to a divorce very early in my marriage I can understand.

I glad to see that the site is still primarily intact and still open.

Jeff: leave the site up, but in read-only mode.  Turn off the ability to post stories, diaries, logs, or comments.  Leave whatever remains as a historical archive, preserved like a fly in amber.

I'm serious.

It is clear that IPW can no longer serve the purposes for which it was founded.  It is no longer, and can never again be, a forum for free and unfettered discussion.

The world is on notice that IPW is now a censored site -- censored by whomever it displeases, so long as they trouble themselves to threaten a frivolous lawsuit.  Even if that never happens again, we all know that it might, and we are apparently expected to exercise prior restraint by confining ourselves to the innocuous.

I do not mean to criticize you for your decision.  It is hard enough to pay the price for one's ideals.  It is even harder to make your family pay the price as well.  You have already contributed far more than I ever have, and I will always be grateful for it.  But it's over, and there is no point in pretending otherwise.

I left Groklaw in part because of its blatant and ham-handed censorship.  For much the same reason I must sadly bid adieu to IPW.  May it rest in peace.

I noticed the outage, just before I left for a long weekend away.  Obviously there was no indication at that time of the cause.  I come back to see that you've agreed a settlement, and that (according to merkeylaw) that settlement has been repudiated by Merkey.  I don't know what lies behind that repudiation, or indeed, if things have moved on from that, but have not been reflected on that site, but I expect that you have tried or will try to resolve whatever difficulty has arisen.

I won't try to pretend that I'm not both shocked and disappointed.  I had come to believe that your stance on the lawsuit was different from what it turned out to be.  That was perhaps wishful thinking upon my part, perhaps on all of our parts.  Certainly it was nothing any of us had the right to expect.

Of course I would add my voice to the others who have expressed their respect for your decision, and their support for you and IPW.

You might as well take the rest of the site down now, since if a serious litigant threatens you with something real you've already demonstrated that you'll bail.
